Nebraska cannabis history

Reviewed

The Nebraska Supreme Court says voters approved two medical-cannabis initiatives at the November 2024 general election, and that the Governor certified them as enacted. The Medical Cannabis Commission said on July 20, 2026 that milestones remained before the program could become operational and before patients could receive services. Its application page says dispensary applications have not opened.

This is a short history, not legal advice. The rules that apply today are on the Nebraska cannabis laws page. A date is included only when the linked page states it.

At a glance

Initiative Law 2024For a qualified patient who meets the Patient Protection Act, using, possessing, and acquiring an allowable amount is not a state or local offense.
September 11, 2026A suit seeking to block the acts was dismissed for lack of standing. The court affirmed that dismissal. The opinion does not say the acts were enjoined.
July 20, 2026The commission said patients could not receive services until licensing, inspection, and tracking systems were built. That is not a statement that a dispensary is open.

The initiatives and the commission

  1. The court describes the laws as enacted pursuant to the initiatives. Secretary of State canvass totals were not the page used for a vote count.
  2. In a companion case, the court affirmed the district court order rejecting pre-election signature challenges to the two petitions.
  3. The commission was accepting manufacturer applications only. Dispensary applications were pending legislative action.
